Welcome to KhpalGo (the "App", "Platform", "We", "Us", or "Our"). By downloading, installing, browsing, or using the KhpalGo mobile application or website, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using our services.
If you do not agree to these Terms, you must immediately cease using the platform.
KhpalGo provides an online marketplace that connects independent restaurants, grocery stores, and Merchant/Vendor/Restaurant with consumers ("Users", "You") and independent delivery partners ("Drivers") to facilitate the ordering, preparation, and delivery of food, beverages, and other items.
Crucial Legal Disclaimer: KhpalGo is a technology platform only. We do not prepare food, sell groceries, or employ delivery drivers. We are not responsible for the quality, safety, or legality of the items provided by Merchant/Vendor/Restaurant, nor are we liable for the actions or omissions of independent Drivers.
Eligibility: You must be at least 18 years old (or the legal age of majority in your jurisdiction) to create an account and place orders.
Account Accuracy: You agree to provide accurate, current, and complete information during registration (such as your phone number, delivery address, and payment details) and keep this information updated.
Security: You are solely responsible for maintaining the confidentiality of your account credentials. Any activity that occurs under your account is your responsibility.
Order Acceptance: Once you place an order, it constitutes an offer to purchase. KhpalGo or the Merchant/Vendor/Restaurant reserves the right to reject or cancel any order at any time due to item unavailability, delivery radius limitations, or suspicious account activity.
Pricing & Taxes: Prices listed on the App are determined by the Merchant/Vendor/Restaurant and may differ from dine-in prices. Total order costs include the price of items, applicable taxes, delivery fees, and platform service fees.
Modifications: Merchant/Vendor/Restaurant may occasionally run out of certain ingredients or items. If an item is unavailable, we or the Merchant will attempt to contact you to arrange a substitution, or remove the item from your bill.
Payment Methods: KhpalGo accepts COD for now and we will soon update our payment options.
Charge Authorization: By placing an order, you authorize KhpalGo to charge your selected payment method for the full amount.
Refund Policy:
Due to the perishable nature of food, all orders are final once accepted by the Merchant/Vendor/Restaurant.
Refunds or credits may be issued at KhpalGo's sole discretion in cases of completely wrong orders, missing items, or severe delivery failures. You must report any issues through App Support within 2 hours of delivery, accompanied by photographic proof if requested.
Delivery Times: Estimated delivery times provided on the App are approximations only. Delays may occur due to traffic, weather, kitchen backlogs, or unexpected circumstances. KhpalGo does not guarantee exact delivery times.
Failed Delivery: If a Driver is unable to complete a delivery because you provided an incorrect address, failed to answer the door, or were unreachable by phone within 10 minutes of arrival, you will still be charged the full amount of the order, and no refund will be issued.
When using KhpalGo, you agree not to:
Use the app for any fraudulent, illegal, or unauthorized purpose.
Create multiple or fake accounts to abuse promotional codes or discounts.
Abuse, threaten, or harass KhpalGo customer support agents or delivery drivers.
Attempt to bypass, disable, or interfere with the security features of the App.
To the maximum extent permitted by applicable law, KhpalGo, its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the platform.
We are not liable for any illness, allergic reactions, injury, or foodborne illness caused by consumption of items ordered from Merchants through our platform. It is the User's sole responsibility to inform Merchants of any food allergies.
KhpalGo reserves the right to modify, amend, or update these Terms and Conditions at any time. Any changes will become effective immediately upon being posted within the App. Your continued use of the platform after changes are posted constitutes your explicit acceptance of the updated Terms.
